READING POST OFFICE SPORTS & SOCIAL CLUB (an unincorporated association) (in liquidation)
TAKE NOTICE that Robert Christopher Keyes and Gareth Wyn Roberts of KRE Corporate Recovery LLP, Dukesbridge House, 23 Duke Street, Reading, RG1 4SA, the Joint Liquidators of Reading Post Office Sports & Social Club (in liquidation) ("the Club") intend to apply to The County Court at Reading, 160-163 Friar Street, Reading, RG1 1HE on 29 April 2016 at 10:30am for:
1. Directions that:
a) "Members" of the Club are comprised of full, associate and honorary members;
b) The following persons who have approached the Joint Liquidators claiming to be members of the Club are deemed to be Members: Mr John Richard Butland and Mr Alan Chandler;
c) The Joint Liquidators be authorised to distribute to Members on an equal basis the net surplus assets of the Club, after payment in full of all creditors and costs and expenses of the winding-up in accordance with the winding-up Order dated 23 February 2015 and rule 4.221 of the Insolvency Rules 1986;
d) To the extent that the Joint Liquidators have received notice that a Member is deceased, or have had letters of service of the winding-up Order returned indicating that a Member has moved (with no forwarding address being provided), the Joint Liquidators shall not be required to include those Members in the said distribution and such Members shall not be entitled to participate in the same;
e) Notice of the Order for directions shall be published in the London Gazette and the Reading Chronicle within 28 days and any person claiming to be a Member shall have liberty to apply, within 28 days after the notice has been advertised, to vary or discharge the Order; and
f) Any distribution payments to Members which have not been claimed within 6 months of the date of payment may be cancelled and be treated as bona vacantia upon the Joint Liquidators ceasing to act, or shall be distributed in such manner as the Court directs; and
g) Service of this application may be effected by advertising the same in the London Gazette and the Reading Chronicle not less than 14 days before the hearing.
2. An Order that the Joint Liquidators' costs of this application be paid out of the assets of the Club.
3. Such other Order be made as the Court thinks fit.
