A COURT has heard that a man accused of rape was told ‘no’ by the alleged victim for about 15 minutes during the purported incident.
Daniel Tyler, of Drovers Way in Woodley, Reading has been charged with one count of digital penetration and one count of rape.
Reading Crown Court heard on Monday, March 6, that the 37-year-old allegedly assaulted a woman, who cannot be named for legal reasons, during a social gathering in May 2018 despite her saying ‘no’ and ‘physically pushing him away’.

Prosecuting, Gary Venturi said: “He visited her in the morning with his friends and she had her friends present.
“Mr Tyler had been making a few comments that made her uncomfortable and when they were alone he then carried her upstairs and threw her onto the bed.
“She began at that point to say no and tried to physically push him away. She went to the bathroom and Mr Tyler followed her and sexually assaulted her before physically taking hold of her again and carrying her to the bedroom where he carried out rape.

“She was able to send a text to her friend downstairs saying ‘this man did not understand the meaning of no’.
“She was not able to physically push the defendant away. She was telling him ‘no, this is stressing me out’ and told him ‘you need to learn the meaning of no’.
“She was trying to think of how else she could get him to [stop]. It was 10 to 15 minutes of consistent nos.
“Mr Tyler was telling her to ‘shh, you’re making me sound desperate'.”
The woman reported the alleged incident to the police and Tyler was questioned shortly afterwards. The court heard that he answered ‘no comment’ at first but then made a statement.
Reading the statement to the court, Mr Venturi said: “I’ve known her for months, we’ve been texting and chatting. She invited me and some friends round hers for food.

“On arrival we were all chatting and we went upstairs and throughout the time upstairs we were laughing and messing about for about 30 to 40 minutes.
“The door remained open during that time. Everything was completely consensual. When I got home I got weird texts from her saying I need to learn to listen.”
The trial, which is expected to last a week, continues.
